The website located at the "Site" is owned and operated by Rootganic (“we," "us," or "our"). Your use of the Site signifies your agreement to be bound by these Terms of Service, our Privacy Policy, Shipping Policy, Refunds & Return Policy, and any additional terms that may apply to specific sections of the Site or to products and services available through the Site from us. Using the Site in any way means you are bound by these Terms of Service.

We reserve the right to modify these Terms of Service, posting updated versions on the Site. Continued use of the Site after changes means you accept the new Terms of Service.

Our Limited License to You: The Site and its contents are our property or that of our affiliates or licensors, protected by intellectual property laws. Rootganic does not control the messages, information, or files provided by you or others. Rootganic may cancel or terminate your right to use the Site or any part of it at any time without notice, and upon such termination, you must cease all use of the Site and its content.

To receive a full refund, the entire order, including opened and unopened products, must be returned. Return shipping costs are the responsibility of the purchaser. If only part of an order is returned, a proportional refund may be issued. Once an order is placed, it cannot be changed or canceled due to immediate order processing.

Rootganic offers products on a subscription basis, meaning regular shipments and charges to your credit card. Pre-shipment notifications allow you to cancel or change your subscription. To cancel, you must contact Rootganic through the provided support email.

Rootganic complies with the DMCA, which offers recourse for copyright owners who suspect infringement. Should you believe your work is unlawfully appearing on our Site, you or an authorized agent can send a notice for content removal or to block access, adhering to DMCA standards. Conversely, if an infringement claim is mistakenly made against you, the DMCA provides the opportunity to submit a counter-notice. Rootganic's designated agent will handle all such notices, which must meet the current statutory requirements to be recognized.

The agreement and associated rights may not be transferred by you without Rootganic's written consent but can be assigned by Rootganic to any affiliated entity or wholly owned subsidiary. The terms will bind and benefit both parties along with their successors and legal representatives.

The terms are governed by Idaho law, and any disputes will be resolved via binding arbitration in Boise, Idaho. This means that rather than going through the courts, an arbitrator will make the final decision on any disagreements arising from the use of the Site.

You agree to resolve any disputes with Rootganic on an individual basis. You are not permitted to bring claims against us as a plaintiff or a class member in any class, consolidated, or representative action. Arbitrations will not combine multiple individuals’ claims unless all parties involved give their explicit consent post-initiation of the arbitration.

If any provision within these Terms is deemed illegal or unenforceable, it will be excised, leaving the remainder in effect. Should the Class Action Waiver be deemed unenforceable, then the dispute resolution by arbitration becomes void, and disputes will be settled in court.
